LANCASTER, Ohio (WTVN)-- The Clerk of Courts in Fairfield County is charged with theft in office, along with her husband.
Deborah Smalley was arrested Wednesday morning at her home in lancaster home, and was set to appear in court later in the day. The third-degree felony charges follow an investigation by the state Auditor's office.
Officials say Smalley had her employees work on her campign, while still on the clock for her office. The investigation began over the summer.
Smalley's husband, Dave, is also charged with complicity, a fourth-degree felony, in relation to the investigation.
The Fairfield County Sheriff's Office says Dave was caught on video bringing and removing items from her office back in June. Other restrictions were placed on both Deborah and Dave during the investigation.
