COLUMBUS, Ohio (WTVN) -- The attorney for ousted Ohio State University Marching Band Director Jon Waters says they'll fight to clear his name.

"I can't tell you what, if any defense there will be, or what, if any action there will be. I can tell you that one way or another Jon intends to fight to clear his good name. I simply don't know what form that will take," said attorney David Axelrod in an exclusive interview with NewsRadio 610 WTVN's Joel Riley.

He says Waters did everything possible to try and change the culture of the band.

"Jon is a genuinely fine person who has attempted to do the right thing at every turn and we believe that he is being blamed for things that he couldn't control," said Axelrod.

Axelrod cites comments from two staff members in the report that claim no one has done more to try and change the culture of the band than Waters. He also believes the report is very one sided since the band members interviewed were picked by the person who filed the complaint.

Waters was given a copy of the report on Wednesday, according to Axelrod. It was made public a day later.
