LEBANON, Ohio (WTVN)--The announcement Thursday allowing many of Ohio's entertainment centers to reopen did not include Cedar Point, Kings Island, or many other major waterparks in the state, and that has led to a lawsuit.
Cedar Fair has taken legal action in Warren County against Ohio Department of Health Director, Dr. Amy Acton, and the Warren County Health Department, saying Dr. Acton lacks the authority to order the restrictions preventing the parks from reopening.
Similar legal action was taken in Erie County, where Cedar Point is located. Cedar Fair owns and operates both Cedar Point and Kings Island. A lawsuit filed there also came from the operators of the Kalahari Resort in Sandusky.
The 1851 Center For Constitutional Law is working on the park's behalf in the legal action.
A lawsuit was filed last month regarding Ohio's gyms and fitness centers, and a judge in Lake County ruled in favor of the businesses, allowing them to reopen immediately.
